The project procuror has a view contrary to project contractor’s view how to solve their serious dispute.

Impact

The project manager wants to solve the dispute without changing the project contractor, because it would have negative impact on the project duration and costs.

Recommendation

The project manager should use the alternate dispute resolution (ADR). It is opposite to authoritative dispute resolution e.g. by arbitration, litigation (solution enforced by legal action) or other use of force. Alternate dispute resolution is any method of resolving disputes without litigation. It means dispute resolution by negotiation for compromise or by negotiation for conjunction of interests. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation and arbitration.
